Causing death by dangerous driving is arguably the most serious of motoring offences and is dealt with in the Crown Court. For offences committed on or after 28 June 2022 the maximum sentence is life imprisonment. In addition, the court will impose a mandatory disqualification from driving, the minimum period being 5 years with a compulsory extended re-test before you can drive again.

Causing death by careless or inconsiderate driving can be dealt with in either the Magistrates’ Court or the Crown Court depending on the specific circumstances of the case. If the matter is dealt with in the Magistrates’ Court the sentence is a maximum of 6 months imprisonment, whereas in the Crown Court, the sentence increases to a maximum of 5 years imprisonment. The court will also impose a driving disqualification for a minimum period of 12 months and has the discretion to order an extended re-test.
